The state of New Jersey legislature and federal government have passed laws that require an employer to make reasonable accommodations with disabilities. These laws have a wide array of application and apply to many situations. The New Jersey Law Against Discrimination (NJLAD) prohibits discrimination in employment against persons who are disabled. Unlike various federal laws (such as Title VII of the Civil Rights Act of 1964, American with Disabilities Act, Age Discrimination in Employment Act), the NJLAD applies to all employers regardless of the number of persons employed. N.J.S.A. Section 10:5-12.
New Jersey has a very broad interpretation of the term disability – essentially any condition, physical or non-physical, even a minor condition, could be considered a disability. The law requires an employer to reasonably accommodate an employee’s disability to the extent necessary to allow the disabled employee to perform the essential functions of the job, unless such accommodation would impose an undue hardship on the operation of the employer’s business. N.J.S.A. 10:5-4; NJAC 13:13-2.5
